Consumer Health Data Privacy Notice

The one health-related thing we may process — and your control over it.

This notice is separate from our Privacy Policy and covers a single, optional feature. It exists because some state laws — including Washington’s My Health My Data Act and Nevada’s SB 370 — define “consumer health data” very broadly, and one optional part of The Last Relay could fall within it. This notice is provided to be transparent and to give you clear control; it is not legal advice, and its scope is subject to review by counsel.

The feature, in one paragraph

The Last Relay is a dead-man’s switch. If you enable the incapacity option, then — and only then — when your trusted contact is asked “can you reach them?”, they may also answer “they’re alive but unable to respond.” That answer is information about your physical condition, so we treat it as consumer health data. The option is off by default. It works only after you give the separate consent described below, and you can withdraw that consent at any time.

01 What data, and its source

Category: a status assertion about you — that you are alive but unable to respond — which relates to your physical or mental health status, together with the timestamp and the fact that your trusted contact provided it.

Source: your trusted contact, when they answer a reachability check. We never derive it ourselves, and we never receive any diagnosis, medical record, or detail beyond that single answer.

02 Why we process it

For one purpose only: to apply the release policy you chose in advance for that situation — either to treat it like “reached” (nothing releases) or to begin your capsule’s final countdown. We do not use it for anything else, ever.

03 Who it is shared with

The answer is stored in your capsule’s activity log in our database (Neon) and, because it arrives and is confirmed by email or phone, is handled in transit by our email provider (Resend) and, if your contact answers by phone, our telephony provider (Twilio). We do not sell it, share it for advertising, or disclose it to data brokers. See our Privacy Policy for those providers.

05 Your rights: withdraw, access, delete

06 Retention

An incapacity answer persists in your capsule’s activity log for the life of the capsule and is erased when the capsule or account is deleted, on the same schedule as the rest of your capsule data (see Privacy Policy § 6). Withdrawing consent stops any further processing going forward.
